AGREEMENT OF LEASE


Between

You Need A Vacation Rentals N.V. established at unit 401-I, Sun Plaza, L.G. Smith Blvd 160, Oranjestad, Aruba (“Vacation Rentals agent on behalf of owners”) and the guests.

The following are the conditions of lease of the rental home you are booking.

This rental home may be occupied by the maximum (including all children above the age of 2) stated in the description. Please note your reservation will be refused if you exceed the maximum occupancy.

All our rental homes are privately owned and we only rent to families or couples. We do not rent to groups of singles or to groups under the age of (30) thirty years of age, unless accompanied by an older family member.

We will request full address details of the leading guest who booked the rental.

Lease Conditions

Check in time on arrival date will be after 2 p.m. Check out on departure date will be  at 10 am. Please note we are flexible with our check out times if we do not have any guest Check – ins the same day.

Early Check-in or late checkout will not be allowed.

Late check-ins will have the following additional fees applied: Between 6 pm to 9 pm US $ 50.00 and between 9 pm to 12 am (midnight) US $ 100.00.  

A late check out-fee of  US $20.00 will be automatically due and payable and applied to your invoice if the Rental Home is vacated after 10 am on departure date. We are

flexible with times if we don’t have any guests arriving the same day at no additional charge. However a late check-out time must be approved by us first.  

Use of Rental Home

Guest shall use the Rental Home for the sole purpose of recreation with a maximum of the prior announced guests. Guest is not allowed to sub-let the Vacation Home.

Rental fee

The fee for the rent of the Rental Home will be payable in full at   the latest one (1) month prior to arrival date. All rental rates are subject to Government tax changes.

The rental fee includes a one-time linen- and towel setup, the costs of electricity, gas, water and cable television.

To reserve the property thirty (30) % of the total rental fee must be paid by Guest, failing which the reservation will be cancelled automatically.

At least one (1) month prior to arrival date, the remaining seventy (70%) of the rental fee must be paid by the guest, failing which the reservation will be cancelled automatically.

Please note if your reservation is less than 4 weeks away a member of our staff will contact you the next working day for full rental payment.

Cancellation

No refunds on any rental payments. 

Covid-19 policy exception

In the event flights are cancelled or boarders are closed due to Covid-19, the guest will be offered a free of charge date change (postpone guest reservation) within a 24 month period of the original booking date. Any money paid will be transferred as credit towards a new reservation for the same property. There will be no refunds made, only forward credit.

Reservation modification

Any date changes made to a reservation once the booking has been confirmed will be subject to availability and a $59.00 administration fee.

As our properties are privately owned it is not possible to change properties once the reservation has been made.

Security Deposit

Upon reservation and accepting the terms of this agreement, a security deposit of US $ 500.00 will need to be paid. The security deposit will not be applied towards the rental fee, which is separately due.

The security deposit will be retained throughout the rental period as security for additional fees, costs and damages that may occur during the rental period such as:  

  • Damage done to the Rental Home, Pool, or its contents, beyond normal wear and tear.
  • A penalty fee of US $ 1,000.00 for smoking inside the Rental Home.
  • A penalty fee of US $ 1,000.00 for damage due to wet clothing on any interior furniture or fixture.
  • A penalty fee of US $ 1,000.00 in case pets were allowed in the Rental Home.
  • A penalty fee of US $ 1,500.00 in acts requiring pool drainage and sanitation.
  • All charges accrued during the stay are paid prior to departure.
  • Damage to or loss of linens or towels.
    • Minimum fee of US $ 25.00 per beach towel.
    • Minimum fee of US $ 15.00 per bath towel, hand towel, and wash cloth.
    • Minimum fee of US $ 75.00 per fitted or flat sheet.
    • Minimum fee of US $ 25.00 per pillow case.
    • Minimum fee of US $ 120.00 per color or white blanket.
    • Minimum fee of US $ 60.00 per pillow sham.
    • Minimum fee of US $ 35.00 per pillow.
    • Any other missing inventory, not listed above, will have a penalty fee of total replacement costs, plus 10% administrative fee for replacing item.
  • Late checkout.
  • Towing fees.
  • Plumbing charges in case of a violation of Article 15 of this contract.

If any of these events or other violations of the rental agreement occur, our company will deduct the subsequent fees and damages from the deposit. In case the total of damages and fees to be covered by Guest are higher than the deposit, the excess amount in damages and fees is immediately due and payable. All costs You Need A Vacation Rentals N.V. shall have to make to effectuate its rights under this agreement in or out of Court, including a maximum of 20% collection charges fees of legal advisors or lawyers, are for the account of the Guest.

The (remainder of the) deposit will be refunded within three (3) business days after departure date, provided the following provisions are all met:

  • Guest has left the Rental Home voluntarily and the Guest is not evicted by Vacation Rentals management, the local law enforcement, or the security company hired by Vacations Rentals management.  
  • All keys are handed back to Vacation Rentals management. 
  • All inventories are accounted for.

Miscellaneous house-rules

It is strictly forbidden to smoke inside the Rental Home. The Rental Home is a  designated non-smoking Rental Home. Smoking is only allowed outside in the designated area.  A fine of US $ 1,000.00 will be issued to anyone found smoking inside the home or throwing cigarettes throughout the property. There is an ash disposal receptacle provided in the designated smoking area outside the back of the house. Please ensure cigarettes are placed here and put out before you leave the area.

Pets are not permitted in the Rental Home.

All debris, rubbish and discards must be placed in the appropriate trash receptacles, and soiled dishes must be hand washed and cleaned throughout the rental period.

While linens and bath towels are included in the Rental Home, daily maid service is not included in the rental rate. However, it is available at an additional rate using a local company. We  suggest you bring your own beach towels as we do not permit towels or linens to be  taken or removed from the Rental Home.

Parking is limited to two (2) vehicles per Rental Home. Vehicles are to be parked in designated parking area only.  Any illegally parked cars are subject to towing; applicable fines/towing fees are the sole responsibility of the vehicle owner.

There is no lifeguard on the premises.  All children must have adult supervision at all  times outside in the pool area.  Any child not “potty-tainted” must wear water proof, sealed diapers if they are in the pool area.  Remember there are a certain risks associated with the pool facility. Use is at the users own risk.  

  • Pool is maintained and replenished with chemicals prior to arrival and during your stay. At times chemicals may need to be added closing the Pool for several hours. Check pool maintenance box for report of pool closures and ability of use after service.
  • No glassware is allowed outside or around pool area.  Plastic dishware is provided for outside use.
  • Deck areas may be slippery when wet.  Use caution and no running in pool or deck areas are allowed.
  • No diving is allowed in or around pool.

Please note this is a standard rental agreement and not all of our properties have swimming pools. If a swimming pool is not mentioned in the property description then there is not a swimming pool and these rules can be discarded.

The Rental Home is on a septic system. The mineral content in the water is high. The septic system is very effective; however, it will clog up if improper material is flushed. It is not allowed to flush anything other than toilet paper. No feminine products should be flushed at anytime.  If it is found that feminine products have been flushed and clog the septic system, you could be charged damages of up to three hundred dollars ($300).

  • Do not put food or grease items down drains – use sink strainers and dispose of debris in garbage.
  • Do not use the toilet as a trash receptical.  Use trash can for tissues or other matter.

Garbage should be removed from inside house each evening to outside trash receptacles for refuse company pick up.  

Storm Policy  

Only if, within 48 hours prior to arrival, the following occurs prior, the Rental Fee and the Reservation fee/Security Deposit will be refunded in the event the Guest decides to cancel the reservation and  informs Vacation Rentals of such immediately:

  • The local authorities order mandatory evacuations in a "Tropical Storm/Hurricane Warning area", and
  • A "mandatory evacuation order has been given for the Tropical Storm/Hurricane Warning" area of residence of a vacationing guest.

In such event, Vacation Rental management will refund any advance rents collected or deposited for a reservation that is scheduled to arrive during the "Hurricane Warning" period.  

Travel insurance

It is highly recommended that Guest purchase adequate travel insurance. 

Waiver of liability and responsibility

All of the Rental Homes are privately owned. The owners and You Need A Vacation Rentals N.V. and their agents are not responsible for any accidents, injuries, death, or illness that might occur while on the premises or its facilities. The owners and Vacation Rentals management and their agents are also not responsible for the loss of personal belongings or valuables of the guest. 

Guest expressly assumes the risk of any harm arising from their use of the premises or others whom he invites to use the premises.

The fact that a pool is part of the Villa amenities, the guest assumes all liability and responsibility for anyone in their group entering the pool or pool area intentionally or unintentionally. The villa has multiple walkouts and there are no boundary mechanisms preventing access to the pool.  

Inspection during Rental Period

Vacation Rentals shall have the right to periodically inspect the Rental Home or have the same inspected as to the use of the Rental Home by Guest and the state of same.

Written exceptions

Any exceptions to the above mentioned policies must be approved in writing in  advance.

Applicable law

Aruban law is applicable to this agreement.  Both parties agree that any suit, legal actions or legal proceedings arising out of or relating to this Agreement may be brought only in the Courts of Aruba and that the applicable law for the interpretation of this Agreement, or for any controversy arising out of this Agreement shall be the law of Aruba.
